After successful completion of the course, students are able to identify the core issues in the execution of architectural projects and to conduct a competent exchange with experts from this field (e.g. lawyers). You know when public procurement law applies and which requirements have to be observed when commissioning by the public sector. You know the main contract types that are concluded for all construction projects from the planning to the final completion of a project. You can identify the legal problems in the event of non-compliance with the contracts and know what the consequences can be.
Contents of the course are, on the one hand, public procurement law, with its European law and international references. In this area, the following questions, among others, should be addressed:• For which projects is procurement law relevant; When are Europe-wide and international tenders carried out? What types of procurement procedures are there (the focus is on the competitions and the negotiation procedure, as well as the realization of complex projects in a competitive dialogue; innovative procurement should also be dealt with). How is the procurement-specific legal protection structured?• How does an award procedure work? How should tender documents be designed? What should be considered when submitting an offer? How is the best offer determined?Another large complex of content of the LV concerns the contractual design of the project realization (the contract as the result of the award procedure, but also in general apart from the implementation of an award procedure). The types of contract relevant to project implementation and construction (construction contract, general planning contract, architect contract, ...) are dealt with and typical content and disruptions to performance (e.g. construction delay, contractor liability, reference to Ö-Norms and other technical standards, ...) are discussed. Lecture. Particular importance is attached to the fact that the content is developed using concrete examples from practice and in a joint discourse with the students. Inclusion of practitioners who examine the contracts presented in the course in the practice of a real estate company and public procurement law in practice from the perspective of a lawyer
