After successful completion of the course, students are able to:     

• distinguish between objective and subjective law as well as public and civil law
• reproduce the basic principles of the Austrian Constitution
• describe general information on administrative law
• explain various legal matters (plant law, construction law, water law, nature conservation law, mineral raw materials law etc.)

Introduction to law: What is law? Law and Justice, Classification of Law, Staged Structure of Legal Norms, Relationship between EU Law and National Law, Interpretation of Legal Norms

basic principles of constitutional law: basic principles of the Austrian constitution, fundamental and human rights, separation of powers, division of competences between the federal government and the Länder, legislative procedure

general administrative law: organisation and functioning of the administration, administrative bodies, control of the administration, administrative procedures, legal protection and administrative jurisdiction

special administrative law: plant law, water law, nature conservation law, mineral raw materials law, environmental impact assessment etc.

The methods for achieving the learning outcomes are:

• lecture with the possibility to discuss
• independent elaboration of the provisions of various legal matters
• additional self-study with the help of the script
• transcript of presented lecture contents as supplement to the script

Voraussetzung für den Zutritt ist ein gültiger Covid-19-Eintritssnachweis (3G-Regel).

Für die Teilnahme am Seminar ist eine Anwesenheit am ersten Seminartag jedenfalls erforderlich! StudentInnen, die über TISS angemeldet sind und bei der ersten Anwesenheitskontrolle nicht anwesend sind, werden automatisch abgemeldet (Nachrücken der StudentInnen auf der Warteliste).

Bei diesem Seminar herrscht Anwesenheitspflicht. Die Kontrolle erfolgt am Beginn und am Ende eines Seminartages! (--> max. 6 Unterschriften für das gesamte Seminar möglich) Ausnahme: Entschuldigungen wie im Arbeitsrecht.

Vor und nach jedem Vortragstermin (04.10./11.10./18.10.) muss zu Hause ein kleines Fallbeispiel (insgesamt 6 Hausarbeiten) erarbeitet werden. 

Beurteilung:

Hausarbeiten  60%, Anwesenheit 10%, Seminararbeit/Referat 30%

Mit der ersten Anwesenheit gilt die LVA als besucht, dh. es wird in jedem Fall auch ein Zeugnis ausgestellt.

Über den Vortragsteil ist ab Anfang Oktober ein Skriptum über TUWEL zum Download verfügbar.

Einige Materialien für die Seminararbeiten werden zT über TUWEL und zT am Institut zur Verfügung gestellt. Dies ersetzt aber nicht die eigene Recherche.

Zudem werden über TUWEL die von den Studenten zu erarbeitenden Kapitel als Handouts zur Verfügung gestellt.
